As between you and ohm, you retain all ownership rights in the materials you submit ("User Content"), including listing photos and video, floor plans, inspection reports, permits, disclosures, descriptions, and other property-related digital assets ("Listing Materials"). ohm does not claim ownership of them.
You grant ohm a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt, create derivative works from, publish, display, and distribute your User Content, in order to (a) operate and secure the ohm services, (b) improve and develop our products, and (c) perform data analysis, market insight, benchmarking, and derived analytics — including creating and commercializing aggregated, de-identified data.
This license does not cover open-house visitors' personal or identifying information (names, contact details, sign-in and consent records). That information is governed only by the Privacy Policy, the visitor's own consent, and applicable law (CCPA/CPRA, TCPA, RESPA, Fair Housing). Our analytics and market-insight uses are built from non-personal, de-identified data only.
ohm owns the aggregated and de-identified data it derives from platform activity (for example, market trends and open-house benchmarks), provided it does not identify any individual.
You represent and warrant that, for everything you upload, you own it or have all rights necessary to upload it and to grant the license above — including from any photographer, videographer, or inspector who authored it — that it does not infringe anyone's rights, and that your submission does not violate any agreement binding you, including your MLS rules, or any law (Fair Housing, RESPA, DRE advertising rules).
You will indemnify ohm from claims arising out of your User Content or breach of these terms. On account deletion or material purge, ohm deletes or de-identifies your raw content per our Retention & Purge Policy; licenses already granted to aggregated, de-identified data survive, as do copies retained for legal, compliance, or audit obligations.
Nothing here grants ohm rights beyond what you can lawfully grant.
